Please read these terms carefully before using any of our services. By using Insomma Cloud, you agree to be bound by these terms.

Introduction

Welcome to Insomma Cloud (“Company”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of our website at insomma.cloud and all related services, including but not limited to Virtual Private Servers (VPS), Virtual Dedicated Servers (VDS), Windows VPS, and any other hosting products we offer.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

Account & Security

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to:

  • Immediately notify us of any unauthorized use of your account.
  • Use strong and unique passwords for your account.
  • Not share your credentials with any third party without our prior written consent.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account if we suspect unauthorized access or any breach of these Terms.

Services & Products

Insomma Cloud provides cloud infrastructure services including:

  • Cloud VPS — Virtual private servers with NVMe/SSD storage, DDoS protection, and scalable resources.
  • Windows VPS — Windows-based virtual servers with full RDP access and high-speed NVMe storage.
  • Cloud VDS — Virtual dedicated servers with full resource isolation for demanding workloads.
  • Dedicated Servers — Bare metal hardware with 100% dedicated resources (when available).

Service delivery: All services are currently ordered and delivered through our Discord server. Upon payment confirmation, your VPS credentials and access details will be provided via Discord. This process is temporary and will be replaced by an automated platform in a future update.

Service availability, specifications, and pricing are subject to change. We will make reasonable efforts to notify users of significant changes in advance.

Billing & Payments

All prices are displayed in Euros (€) unless stated otherwise.

  • Services are billed on a monthly basis, and payment is due at the beginning of each billing cycle.
  • Payments are currently accepted exclusively via PayPal until further notice. Additional payment methods may be added in the future.
  • Failure to pay may result in service suspension or termination after a reasonable grace period.
  • All fees are non-refundable unless otherwise stated in our refund policy or required by applicable law.
  • We reserve the right to modify pricing with at least 30 days' notice to existing customers.

Acceptable Use

You agree to use our services in compliance with all applicable laws, regulations, and our Acceptable Use Policy. The following activities are strictly prohibited:

  • Sending spam, unsolicited bulk emails, or phishing messages.
  • Hosting, storing, or distributing illegal content, including but not limited to pirated software, child exploitation material, or content promoting violence.
  • Conducting DDoS attacks, port scanning, or unauthorized network intrusions against any system.
  • Mining cryptocurrency without prior written authorization from Insomma Cloud.
  • Running open proxies, Tor exit nodes, or services that facilitate abuse.
  • Violating copyright, trademark, or intellectual property rights of others.

Violation of these terms may result in immediate suspension or termination of your account without refund.

Service Level Agreement (SLA)

Insomma Cloud strives to maintain a 99.9% uptime guarantee for all production services. Our SLA covers:

  • Network uptime — We guarantee network availability of 99.9% measured monthly.
  • Hardware uptime — Server hardware availability is guaranteed at 99.9%.
  • Scheduled maintenance — We will notify users at least 48 hours in advance for any planned maintenance.

Downtime caused by factors outside our control (e.g., natural disasters, third-party outages, customer misconfigurations) is excluded from SLA calculations.

Data & Privacy

Your privacy is important to us. Our handling of personal data is governed by our Privacy Policy. Key points:

  • You are solely responsible for the data stored on your servers.
  • We do not access customer data without explicit consent, except as required by law or to maintain service integrity.
  • We implement industry-standard security measures to protect our infrastructure and your data.
  • We recommend that you maintain regular backups of your data. Insomma Cloud is not responsible for data loss resulting from customer actions.

Intellectual Property

All content on the Insomma Cloud website, including text, graphics, logos, icons, images, software, and the design of the site, is the property of Insomma Cloud or its content providers and is protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any content on our site without our prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable law, Insomma Cloud shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, data, business opportunities, or revenue.
  • Service interruptions caused by events beyond our reasonable control.
  • Damages arising from unauthorized access to your account or data due to your failure to secure your credentials.

Our total liability for any claim arising from or relating to these Terms shall not exceed the total amount paid by you to Insomma Cloud during the twelve (12) months immediately preceding the event giving rise to the claim.

Termination

Either party may terminate the service at any time, subject to the following:

  • By you: You may cancel your services at any time through your account dashboard or by contacting our support team. Cancellations take effect at the end of the current billing period.
  • By us: We may suspend or terminate your account immediately if you violate these Terms, our Acceptable Use Policy, or any applicable law.

Upon termination, all data associated with your account may be permanently deleted after a 7-day grace period, unless otherwise required by law.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the “Last updated” date at the top of this page.
  • Notify active users via email or through a notice on our website.
  • Provide at least 30 days' notice before significant changes take effect.

Your continued use of our services after the changes become effective constitutes your acceptance of the revised Terms.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Insomma Cloud operates. Any disputes arising out of or related to these Terms shall be resolved through:

  • Informal negotiation — Both parties agree to attempt to resolve disputes amicably before pursuing formal legal action.
  • Binding arbitration — If negotiation fails, disputes will be settled through binding arbitration in accordance with applicable commercial arbitration rules.
